This Terms of Use and Service Agreement ("Agreement") constitutes a legally binding and enforceable contract between Insta Suites, a premier hospitality provider incorporated and operating in Pahalgam, Jammu & Kashmir (hereinafter referred to as "the Hotel," "Management," "We," "Us," or "Our"), and you, the guest, visitor, customer, or any entity accessing or utilizing the Hotel’s digital platforms, reservation systems, or physical premises (hereinafter referred to as "User," "Guest," or "You").
PLEASE READ THIS DOCUMENT IN ITS ENTIRETY. BY ACCESSING, BROWSING, SEARCHING, OR FACILITATING A RESERVATION THROUGH OUR SITE OR SERVICES, YOU EXPRESSLY ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND VOLUNTARILY AGREE TO BE BOUND BY EVERY TERM, CONDITION, AND DISCLAIMER CONTAINED HEREIN. IF YOU DO NOT AGREE TO THESE TERMS, YOU ARE PROHIBITED FROM PROCEEDING WITH A BOOKING AND MUST IMMEDIATELY DISCONTINUE ALL USE OF THE SERVICES.
1.1. "The Hotel" refers specifically to the property known as Insta Suites, situated at Pahalgam rafting point, Movera, Pin: 192126, Pahalgam, J&K., including its 14 Deluxe Rooms, restaurant, luxury verandas, and the 1-acre estate grounds.
1.2. "Services" refers to the provision of temporary lodging, culinary offerings (North Indian, Kashmiri, and Mughlai), and the facilitation of local recreational coordination.
1.3. "Booking Confirmation" refers to the digital or physical voucher issued by the Hotel upon the successful processing of a reservation and the required financial consideration.
1.4. "Force Majeure" refers to any event beyond the reasonable control of the Hotel, including but not limited to heavy snowfall, landslides, civil disturbances, government-imposed lockdowns, or acts of God unique to the Himalayan region.
2.1. Age Requirement: You represent and warrant that you are at least 18 years of age and possess the legal authority to enter into this Agreement. Users under 18 must be accompanied by a legal guardian at all times.
2.2. Account Integrity: If you create an account on our booking portal, you are solely responsible for maintaining the confidentiality of your credentials. Any activity occurring under your account is deemed to be authorized by you.
2.3. Misrepresentation: Providing false information (such as using an alias for a booking) is a material breach of this Agreement and may result in the immediate cancellation of your stay without a refund.
3.1. 3-Star Classification Disclosure: Insta Suites is classified as a 3-Star Resort. While we provide high-quality amenities, the User acknowledges that service levels are tailored to this specific industry classification.
3.2. Climate and Amenities (No AC Clause): The Hotel is located in a high-altitude mountain environment. The User acknowledges that Air Conditioning (AC) is not a standard amenity and is not required for guest comfort given local temperatures. No refunds or discounts will be provided based on the absence of cooling systems.
3.3. Inventory Consistency: All 14 rooms are designated as "Deluxe." While layouts may vary slightly, there is no sub-classification of rooms. Requests for specific room numbers are noted but never guaranteed.
4.1. Pricing Fluctuations: Prices displayed on the website are dynamic and reflect real-time availability. The Hotel reserves the right to adjust pricing for seasonal peaks (e.g., Amarnath Yatra period or winter holidays).
4.2. Currency and Levies: All transactions are processed in Indian Rupees (INR). Prices are exclusive of Goods and Services Tax (GST) unless otherwise stated.
4.3. Payment Authorizations: By providing a credit/debit card, you authorize the Hotel to charge the total reservation amount plus any incidental charges incurred during your stay (e.g., bonfire costs, extra meals).
4.4. Verification at Check-in: The physical card used for the booking, or a valid authorization from the cardholder, must be presented upon arrival if requested by Management.
5.1. Mandatory Documentation: Under the regulations of the Jammu & Kashmir Department of Tourism and local law enforcement, every guest must produce a valid Government-issued photo ID (Aadhaar Card, Passport, or Voter ID). Foreign nationals must provide a valid Visa and Passport to satisfy "C-Form" requirements. Failure to provide these documents will result in a refusal of entry.
5.2. Family and Couple-Friendly Mandate: We pride ourselves on being a family-friendly and couple-friendly resort. Any behavior deemed lewd, disruptive, or harmful to the reputation of the Hotel will result in immediate eviction.
5.3. Pet Policy and Liability: Pets are permitted only with prior written consent. Owners assume full financial responsibility for any damage to carpets, furniture, or landscaping.
5.4. Prohibited Items: Firecrackers, hazardous chemicals, and illegal substances are strictly prohibited on the 1-acre property.
6.1. Governing Policy: All requests for refunds are subject to our Refund and Cancellation Policy.
6.2. Non-Negotiable Check-out: Check-out is strictly at 12:00 PM. This is necessary to allow our housekeeping staff to prepare the room for the 3:00 PM check-in cycle. Late check-outs without prior authorization will be billed at 50% of the daily rate.
6.3. No-Show Consequences: If a guest fails to arrive by midnight on the scheduled day of check-in, the Hotel reserves the right to cancel the remainder of the booking and retain 100% of the deposit as a liquidated damage fee.
7.1. Aggregator Disclaimer: The Hotel acts as a facilitator for activities such as white-water rafting, trekking to Aru Village, and sightseeing in Betaab Valley. These services are performed by independent local contractors.
7.2. Assumption of Risk: High-altitude activities and river sports carry inherent risks. By requesting the Hotel to coordinate these excursions, the Guest voluntarily assumes all risks of injury or property loss.
7.3. Transport Services: Airport pick-up and drop-off from SXR Airport are provided on an "on-request" basis through third-party transport partners. The Hotel is not responsible for delays caused by traffic, weather, or mechanical failures of these vehicles.
8.1. Operational Hours: Our on-site restaurant operates from 7:00 AM to 11:00 PM.
8.2. Dietary Disclaimers: While we offer specialized North Indian and Kashmiri cuisines, guests with severe allergies must inform the kitchen staff in writing. The Hotel cannot guarantee a 100% allergen-free environment.
8.3. Riverside Bonfires: Bonfire services are provided at an additional cost and are subject to weather conditions and local environmental regulations.
9.1. Property Loss: The Hotel provides in-room security measures; however, we are not liable for the loss of jewelry, cash, or electronics left unattended in rooms or verandas.
9.2. Maximum Liability: In any event, the total aggregate liability of Insta Suites for any claim arising out of this Agreement shall not exceed the total amount paid by the Guest for the booking in question.
9.3. Indemnification: You agree to indemnify, defend, and hold harmless Insta Suites and its officers from any claims, suits, or damages arising from your negligence, violation of local laws, or breach of these Terms.
10.1. Content Ownership: All text, imagery of the mountain views, and the digital architecture of the booking engine are the intellectual property of Insta Suites.
10.2. Usage Restrictions: You may not use our brand name, logos, or "Insta Suites" trademark for any commercial purpose without express written licensing from the Management.
11.1. Jurisdiction: This Agreement is governed by the laws of the Union Territory of Jammu & Kashmir and the Republic of India.
11.2. Arbitration: Any dispute arising hereunder shall first be attempted to be resolved through good-faith mediation. Failing that, disputes shall be settled through binding arbitration in Anantnag, in accordance with the Indian Arbitration and Conciliation Act.
12.1. Severability: If any clause is found to be unenforceable, the remainder of the Agreement stays in full effect.
12.2. Entire Agreement: This document, alongside the Privacy Policy and Refund Policy, constitutes the entire legal understanding between the parties.
